The Golf Digest Rewards MasterCard®
Credit Card Program Rules

The following terms and conditions (collectively the “Program Rules”) govern participation in the GOLF DIGEST Rewards program (the “Program”). The Program Rules include information describing how the co-branded MasterCard® credit card issued by FIA Card Services, N.A. (also referred to as the “ISSUER”) which bears the name and/or logo of Bank of America and of THE GOLF DIGEST COMPANIES (“GOLF DIGEST”) (hereinafter referred to as the “Card”), enables you to participate in a customer loyalty program. The benefits of the Program consist of the ability to earn GOLF DIGEST reward points and use the points to obtain Golf Merchandise, Travel Rewards, and Electronics (“Rewards”). A complete selection of Rewards is displayed online at golfdigestrewards.com (the “Site”) and a brochure containing a list of Rewards will accompany new account materials. Travel and Electronics rewards are fulfilled by Carlson Companies, Inc. (“Carlson”). Golf Merchandise rewards will be fulfilled by Golfmor, Inc. (“Golfmor”).

As used herein, “Cardholder,” “Participant,” “you,” and “your” refer to the applicant and co-applicant, if any, who are approved for the Card.

Any use of your Card will constitute your acknowledgment of each of the terms described below and the terms of the Credit Card Agreement, including its provisions regarding the use of arbitration to resolve Claims (as defined in the Credit Card Agreement). The Program Rules are not part of the Credit Card Agreement. Please read this document carefully and keep it in a safe place.

To qualify for participation in the Program you must:

  1. Maintain an open Card (i.e., open and with charging privileges) with the ISSUER; and
  2. Be an individual (corporations, partnerships, and other entities may not participate); and
  3. Be at least 18 years of age (21 if a permanent resident of Puerto Rico) and maintain an established residence within the United States.

If your participation in the Program should end and you are otherwise eligible, ISSUER may, at its discretion issue a replacement credit card account for you. A replacement account will not provide you with access to any Program benefit.

For new Cardholders: you may begin to earn Points through use of the Card as of your Enrollment Date. Enrollment Date means the date ISSUER mails the Card and the Credit Card Agreement to you.

For participants in the previous GOLF DIGEST Rewards Program: Points earned under the previously published terms which have not yet expired will be subject to the terms described below and will expire May 1, 2009, or when the Program ends, whichever is earlier.

Earning Golf Digest Rewards Points

Each Cardholder shall be eligible to earn reward points (“Point(s)”) based on use of the Card for purchase transactions. Points are used to obtain Rewards. The Cardholder’s Points earnings shall be determined by calculating the new net retail purchase dollar volume (i.e., purchases less credits, returns and adjustments) charged to the Card during each periodic billing cycle (“Billing Cycle”) by the Cardholder and authorized user(s), if any (“Net Purchases”). Cardholders earn one (1) Point for each dollar (US $1.00) in Net Purchases made anywhere the Card is accepted. Fractions of dollars shall be rounded to the nearest whole dollar. Balance transfers; cash advances, including purchases of cash equivalents of any kind; out-of-network payments made through the Bill Pay Choice® service; purchases made by or for a business or for a business purpose; fees; finance charges; credit protection; credit insurance or debt cancellation charges; unauthorized/fraudulent transactions, shall not earn Points. While the Program continues, all Points shall be valid for a period of sixty consecutive Billing Cycles from the time they first appear on your Billing Cycle statement (“Statement”). There is no maximum number of Points that can be earned. Point earnings are subject to purchase verification and adjustment. From time to time, Double Point earning opportunities will be made available and details will accompany each offer.

Redeeming Points for Rewards

To redeem Points for Rewards, you must call the Carlson GOLF DIGEST REWARDS Redemption Center at 1-800-889-8747, or log on to www.GolfDigestRewards.com. Requests to redeem Points must be made by either the Cardholder(s) or an authorized user of the Card and the Card must be in good standing (i.e., be open and have active charging privileges) at the time the request is made and/or is fulfilled.

Travel Rewards

Travel Rewards are available in the form of certificates or vouchers issued by participating properties or other entities. Those currently participating in the Reward Program include: Ritz -Carlton Hotels and Resorts, Marriott Hotels and Resorts (including Renaissance Hotels and Resorts), Hyatt Hotels & Resorts, Wyndham Hotels & Resorts, Hertz, Budget Rent A Car, and Avis. Reward providers are subject to change at any time. A selection of available Travel Rewards will be published in the Rewards Program List sent to you from time to time, or you may visit www.golfdigestrewards.com for the most up-to-date list of Rewards.

To use your Points, you must contact Carlson and advise which Travel Reward you would like to receive. Rewards consist of awards such as stays of various lengths at any participating hotel or resort, airfare, or discount vouchers for services offered by or through the provider. Significant terms and conditions may apply to use of some Rewards, e.g., Saturday night stay requirement for air rewards. Costs not covered by the Reward (e.g., personal charges, food and beverages, additional person(s), and other optional and incidental expenses, or upgrades) will be detailed on each certificate or voucher and are your responsibility: you earn Points for additional costs charged to the Card. Travel Rewards are subject to availability.

Determination of certificate/voucher expiration dates are made by the provider. Certificates/vouchers must be surrendered at the time of use, and no photocopies or other facsimiles will be honored. Certificates/vouchers may not be sold, exchanged, refunded, transferred, or redeemed for cash, and cannot be replaced if lost or stolen. Any unused portion of a certificate/voucher will not be returned as cash unless it is the policy of the provider to do so. Each provider may place restrictions on the use of its offer, including age or geographic limitations. Use of certificates/vouchers is subject to any additional restrictions contained on or with the certificate/voucher and certificates/vouchers are void where prohibited by law. Please inquire about details of use when you call to request the Reward.

Shipping of Rewards

Basic shipping costs within the continental U.S. are included in the value of the Reward. Rewards will be shipped via UPS ground service, or similar. Allow 3-6 weeks for delivery. If you wish expedited delivery, and either Carlson or Golfmor confirms the service is available, the cost of the expedited shipment expense will be charged to your Card. You will be responsible for charges incurred in connection with shipments to addresses outside the continental U.S. (e.g., Hawaii, Alaska, or Puerto Rico), if such service is available.

If you wish to return a Reward, you must obtain Return Authorization from Carlson or Golfmor, as appropriate. Used merchandise will not be accepted for return. Merchandise must be returned within 30 days of its original receipt by you. Because ISSUER and/or GOLF DIGEST are not responsible for defective equipment or mishaps, all responsibility shall lie with the equipment manufacturer’s warranty and procedures.

Miscellaneous Terms

The Cardholder’s Statement will report the number of Points earned during the Billing Cycle along with the cumulative total of unredeemed Points. Each time you redeem the number of Points required to qualify for one or more Rewards, the cumulative total will be reduced by the appropriate number of Points used to obtain the Reward. Points are not available for redemption until they have been reported on a Statement. You may check the status of your Points total by visiting www.BANKOFAMERICA.com.

Questions or disputes concerning your Points will be determined according to the Program Rules in effect when the relevant transaction posted to your Card. All discrepancies regarding Points must be brought to the attention of ISSUER within six (6) months from the posting date of the transaction for which the adjustment is sought. Such discrepancies are not the same as billing disputes and the separate resolution requirements that are applicable to them. Refer to your Statement for details about credit card billing disputes.

ISSUER will resolve questions regarding the earning or use of Points. Points may not be brokered, bartered, sold, or altered in any way. Any person or entity selling, purchasing, brokering, bartering, or altering Points shall be liable for payment of the applicable full retail price of any goods or services obtained with them, as well as all damages including, but not limited to, consequential damages, litigation costs (including attorneys fees and costs) and transaction costs. Any brokered, bartered, altered, sold, or purchased Points shall be void and may be canceled or confiscated either by, or upon the direction of ISSUER. Any violation of this rule will result in termination of a Cardholder’s Program eligibility and nullification of unused Points.

Points cannot be transferred between any credit card accounts issued by ISSUER. Under no circumstances may Points be used to pay off or pay down any credit card balance. Points earned through use of the Card may not be combined with other discounts, rates, promotions, or reward programs offered by any other entities, or by ISSUER, unless specifically authorized. Points do not constitute property of the Cardholder and are not transferable by operation of law or otherwise to any person or entity. Points may not be transferred upon death or as part of any domestic relations or other legal proceeding. If you voluntarily cancel your participation in the Program, unused Points will be irrevocably forfeited.

If a Cardholder is denied a benefit of the Program to which he or she is entitled, any liability of ISSUER and/or GOLF DIGEST shall be limited to the Cardholder’s earned portion of that benefit. ISSUER and GOLF DIGEST are not responsible for any correspondence that is lost or delayed in the mail, or was transmitted electronically.

GOLF DIGEST reserves the right to substitute or withdraw the Reward selections or other Program specifics without providing prior notice to Cardholders. While the selection of Rewards will be updated each calendar year, specific Rewards may be unavailable based upon manufacturer supply and/or other circumstances.

ISSUER may, from time to time, and in its discretion, change the Program Rules without notice and/or terminate a Cardholder’s participation in the Program. ISSUER reserves the right to terminate the Program with at least 90 days written notice to Cardholders. Any of the foregoing actions may be taken even if such actions affect the accrual or value of Points already earned.

The Cardholder releases ISSUER and its parent, subsidiaries, affiliates, and successors from any and all liability regarding redemption of Points, or other features of the Program. ISSUER does not endorse or recommend any of the products or services available through the Program.

Liability for any federal, state or local taxes, as may be applicable, arising out of earning or using Points shall be the sole responsibility of the Cardholder.

The terms of this Program may be subject to government approval and are void where prohibited by law.
